Odds are, she'd have agreed to have sex with him in the morning if she'd been awake; so he is probably safe on the grounds that she was asleep (though it's arguable either way). But it seems unlikely she'd have consented to unprotected sex if he'd been awake when he started, so he can't hide behind the 'reasonable to suppose' defense. Beyond the specifics of the Assange case, if it is unreasonable to assume that the sleeping victim consents either to a blowjob or penetration, then some sort of offense occurs. The way you constructed your sentence is very bizarre, by the way; as if the offense lies the act of waking the victim, not the act of havin' 'em while they slumber, with or without protection.
