Its called innocent until proved guilty. Its called being prosecuted in an open court of law (that's prosecuted not persecuted). Its called decency. Unknown principals to anyone in Bushco.

It is illegal for any military tribunal to prosecute POWs unless it is for war crimes.
Simply waging war is not a crime.

Nah... America collected them up, America can take care of them. I wouldn't count on that: Several European countries, including Switzerland, Ireland and Portugal have signaled they would be willing to accept Guantanamo detainees.
