I'm not sure I really understand this: According to New York state laws, third degree rape is when a "person is guilty of rape in the third degree when he or she engages in sexual intercourse with another person": Who is incapable of consent by reason of some factor other than being less than 17 years old; Who is less than 17 years old, and the defendant is 21 years old or more; or Without such person's consent, which is withheld for some other reason than incapacity to consent. A person is guilty of rape in the first degree when he or she engages in sexual intercourse with another person: By "forcible compulsion" -- compelling the victim through the use of physical force or the threat of immediate death, physical injury or kidnapping; Who is incapable of consent by reason of being physically helpless; Who is less than 11 years old; or Who is less than 13 years old and the defendant is 18 years old or more. It seems to be kiddy rape and violent (or threats-of-violence) rape and drugging rape are first degree. Third degree seems to be shagging a teenager who, by being under the age of consent, is technically unable to consent; or coercive rape like "I won't give you a job in my new film if you don't give me a blow job".

You're approaching it all wrong. Just substitute "cup of tea" for rape and it will all become clear. The CB is forever asking me if want a cup of tea but I never actually get one. She might boil the kettle, she might even get a mug out but that's as far as it goes. .Unless I finish it off for myself I'll never get a cup of tea. I bring her a cup of coffee in bed every morning. It is queer but I think juries are sometimes given choices of what degree of a crime they find a defendant guilty of. I'm not sure if that's a thing here.
