So after watching the weekend political shows it seems pretty clear that the Trump defense is going to claim his right to the freedom of speech. Let's be clear, in no way, shape, or form is this a viable defense.

Example: Someone walks into a packed movie theatre and screams fire (and there is no fire). That is against the law. Now if that speech creates panic, and in the chaos to get out people are injured, that creates other charges.

After your arrest, as terms of your bail, the judge tells you to stay away from movie theaters and not to scream fire in a crowded place, you must abide by that ruling. If you go out he next day and go to a movie theatre and scream fire, your bond will be revoked.

The US 1st Amendment guarantees the right to free speech, but it is not absolute. Sure you can say what ever you want whenever you want, but that does not preclude you from the consequences. And if your speech is criminal, as if used in conspiracy to commit a crime, that speech is no longer protected.

Now if I can explain this, surely a person as educated and knowledgeable as Jack Smith will have little problem convincing a judge and jury of the same. Although I do believe, most everyone already knew all of this.
